Well that's interesting!
Todd, who had sat on the Legislative Council of New Brunswick since 1857, was called to the Senate on October 23, 1867. However, on account of his age and ill health, he declined the appointment as he was unwilling to go to Ottawa. The letters Patent were therefore not issued.
